NoYesOffers (“Company”, “we”, “us”, or “our”) is committed to protecting the privacy and personal data of individuals who access and use the Platform available at www.NoYesOffers.com and/or Mobile Application (the “Platform”). This Privacy Policy sets out the manner in which we collect, use, store, process, and disclose personal information in connection with your use of the Platform.
The Platform operates as a hyperlocal peer-to-peer marketplace that enables Users to connect with one another within their vicinity for the purpose of giving away goods, selling for lowest or cheaper price, discovering available items, or requesting specific goods, either free of cost or at a nominal or cheaper price. In order to facilitate such interactions and provide a seamless and efficient user experience, the Company may collect certain personal information from Users, including but not limited to name, mobile number, email address, and location details.
We may process the personal data of a User only in accordance with the terms specified in this Privacy Policy and applicable data protection laws. Personal data may be processed based on the consent provided by the User or for certain legitimate uses. Consent requests will be accompanied or preceded by a notice, informing the User of the personal data being processed, the purpose of processing, the method to withdraw consent, and the procedure to make a complaint to the relevant authorities. We may continue to process personal data until the User withdraws consent. You acknowledge and agree that We are not liable for any loss or damage which may be incurred by you as a result of the availability of those external sites or resources, or as a result of any reliance placed by you on the completeness, accuracy or existence of any advertising, services or other materials on, or available from, such Platforms. These external third-party Platforms and resource providers may have their privacy policies governing the collection, storage, retention and disclosure of Your Personal Information that You may be subject to. This electronic record is generated by a computer system and does not require any physical or digital signatures.
This legal document is published in accordance with the provisions of Rule 3 (1) of the Indian Information Technology (Intermediaries guidelines) Rules, 2011 and Rule 4 of the Information Technology (Reasonable security practices and procedures and sensitive personal data or information) Rules, 2011 of Information Technology Act, 2000 amended through Information Technology Amendment Act, 2008 that require publishing the Terms of Use and practices for access and usage of any functional Platform.
This Privacy Policy is formulated in compliance with the provisions of THE DIGITAL PERSONAL DATA PROTECTION ACT, 2023, and any other relevant data protection laws applicable to the processing of personal data. The policy outlines the principles and procedures for collecting, processing, and safeguarding personal data in adherence to the statutory requirements set forth by THE DIGITAL PERSONAL DATA PROTECTION ACT, 2023. Users are encouraged to review and understand this Privacy Policy in conjunction with the applicable data protection laws.
CHILDREN’S DATA
The Platform may be accessed by individuals below the age of eighteen (18) years only with the involvement, supervision, and verifiable consent of a parent or legal guardian. In accordance with applicable data protection laws, including the Digital Personal Data Protection Act, 2023, the Company processes personal data of children only upon obtaining such verifiable parental consent. The Company does not knowingly collect or process personal data of children in a manner that is likely to cause harm, nor does it undertake tracking, behavioral monitoring, or targeted advertising directed at children. Where the Company becomes aware that personal data of a child has been collected without the requisite consent of a parent or legal guardian, such data shall be deleted in a reasonable timeframe. DATA RETENTION
The Company retains personal data only for as long as it is necessary to fulfil the purposes for which it was collected, including for the provision of Services, compliance with legal obligations, resolution of disputes, enforcement of agreements, and protection of the Company’s legal rights. Personal data may be retained for the duration of the User’s account being active and for a reasonable period thereafter as required under applicable laws or for legitimate business purposes. Upon withdrawal of consent or upon a valid request for deletion, the Company shall take reasonable steps to delete or anonymize personal data, unless retention is required or permitted under applicable law. LOCATION DATA USAGE
The Platform may collect and process location-related information, including address or approximate geographic location, for the purpose of enabling Users to discover and interact with other Users within their vicinity. Such location data is used solely to facilitate the core functionality of the Platform, including listing visibility, search optimization, and user-to-user connections. The Company does not use location data for continuous tracking, surveillance, or any purpose unrelated to the provision of Services. Users have the option to limit or control the sharing of their location information; however, doing so may affect certain functionalities of the Platform.
USER-TO-USER DATA SHARING
In order to facilitate meaningful interactions and enable the core functionality of the Platform, certain personal information of Users may be shared with other Users. This may include, without limitation, your name, contact details (such as mobile number or email address), approximate or precise location, and any other information voluntarily provided by you through your profile, listings, or communications. Such sharing is inherent to the nature of the Platform, which is designed to enable Users to connect with other nearby Users for the purpose of giving away, requesting, or obtaining goods. By using the Platform, you expressly consent to such sharing of your information with other Users. The Company does not control how other Users may use, store, or process such information once it has been shared with them and shall not be responsible or liable for any misuse, unauthorized use, or disclosure of your information by other Users.
LIMITED IDENTITY VERIFICATION DISCLAIMER
The Platform operates as an open, user-driven marketplace and does not undertake comprehensive identity verification, background checks, or authentication of Users. While certain basic information may be collected during registration, the Company does not guarantee the accuracy, completeness, or authenticity of any information provided by Users. Any reliance placed on user profiles, listings, or representations is at your sole discretion and risk. The Company expressly disclaims any responsibility or liability arising from false, misleading, or inaccurate information provided by Users, and Users are encouraged to independently verify the identity, credibility, and reliability of other Users prior to engaging in any interaction or transaction.
DATA MINIMISATION AND PURPOSE LIMITATION
The Company is committed to collecting and processing only such personal data as is necessary, relevant, and proportionate for the purposes of providing and improving the Services offered through the Platform. Personal data is collected solely for specified, explicit, and lawful purposes, including enabling user registration, facilitating user-to-user interactions, improving platform functionality, ensuring security, and complying with legal obligations. The Company does not collect excessive, unrelated, or unnecessary personal data and undertakes to process such data strictly within the scope of the purposes communicated to the User at the time of collection or as otherwise permitted under applicable law.
ACCOUNT DELETION AND DATA LIFECYCLE
Users may request deletion of their account and associated personal data at any time by contacting the Company through the designated channels. Upon receipt of such request, the Company shall take reasonable steps to delete or anonymize personal data within a commercially reasonable timeframe, subject to any legal or regulatory obligations requiring retention. Notwithstanding account deletion, certain residual data may be retained for limited purposes, including compliance with Applicable Laws, prevention of fraud, resolution of disputes, enforcement of agreements, and maintenance of system integrity. Such retained data may exist in archived or backup systems for a limited duration and shall not be actively used for any commercial purpose. CROSS-BORDER DATA TRANSFER
The Company primarily stores and processes personal data within the territory of India. However, in the course of providing Services, personal data may be transferred to, stored, or processed in jurisdictions outside India, including by third-party service providers engaged by the Company. In such cases, the Company shall take reasonable steps to ensure that such transfers are conducted in compliance with applicable data protection laws and that appropriate safeguards are implemented to protect the personal data of Users. PLATFORM COMMUNICATIONS AND NOTIFICATIONS

Such communications are essential for the provision of Services and may not be opted out of while you continue to use the Platform. THIRD-PARTY TOOLS AND SERVICE PROVIDERS
The Company may engage third-party service providers, including but not limited to analytics providers, cloud hosting services, communication tools, and technical support vendors, to assist in the operation and improvement of the Platform. Such third parties may have access to personal data solely for the purpose of performing services on behalf of the Company and are contractually obligated to process such data in accordance with applicable laws and the Company’s instructions. NO WARRANTY ON DATA SECURITY
While the Company implements reasonable technical and organizational measures to safeguard personal data, no method of transmission over the internet or electronic storage is completely secure or error-free. Users acknowledge and accept that there are inherent risks associated with the transmission of information online, and the Company does not warrant or guarantee absolute security of personal data. To the fullest extent permitted under applicable law, the Company shall not be liable for any unauthorized access, disclosure, alteration, or destruction of personal data resulting from circumstances beyond its reasonable control.
HYPERLOCAL VISIBILITY AND DATA EXPOSURE
Given the nature of the Platform as a hyperlocal marketplace, certain information provided by Users, including location details, profile information, and listing-related data, may be visible to other Users within a defined geographic vicinity. This visibility is essential to enable Users to discover relevant listings, connect with nearby individuals, and participate in the exchange of goods. By using the Platform, you acknowledge and consent to such localized visibility and limited disclosure of your information to other Users. The Company does not control how other Users may use such information and shall not be responsible for any consequences arising from such visibility or user interactions.
DATA FIDUCIARY AND DATA PRINCIPAL
For the purposes of applicable data protection laws, including the Digital Personal Data Protection Act, 2023, the Company acts as the “Data Fiduciary,” determining the purpose and means of processing personal data collected through the Platform. Users of the Platform are considered “Data Principals,” whose personal data is collected and processed in accordance with this Privacy Policy. The Company undertakes to process personal data in a lawful, fair, and transparent manner, ensuring that such processing is limited to the purposes specified and consented to by the User or otherwise permitted under applicable law. Users, as Data Principals, are entitled to exercise their rights in relation to their personal data, as set out in this Privacy Policy and under applicable laws.
CONFIDENTIALITY
You further acknowledge that the Platform may contain information that is designated confidential by us and that you shall not disclose such information without our prior written consent. OUR DISCLOSURE OF YOUR INFORMATION

ACCESSING, REVIEWING AND CHANGING YOUR PROFILE
You can review and change the information you submitted except Email ID. An option for facilitating such change shall be present on the Platform and such change shall be facilitated by the User. If you change any information, we may or may not keep track of your old information. We will not retain in our files information you have requested to remove for certain circumstances, such as to resolve disputes, troubleshoot problems, and enforce our terms and conditions. Such prior information shall be completely removed from our databases, including stored ‘back up’ systems. If you believe that any information, we are holding on to you is incorrect or incomplete, or to remove your profile so that others cannot view it, the User needs to remediate, and promptly correct any such incorrect information.
SECURITY
We treat data as an asset that must be protected against loss and unauthorized access. We employ many different security techniques to protect such data from unauthorized access by members inside and outside the Firm. We follow generally accepted industry standards to protect the Personal Information submitted to us and information that we have accessed.
However, as effective as encryption technology is, no security system is impenetrable. Our Firm cannot guarantee the security of our database, nor can we guarantee that information you provide won’t be intercepted while being transmitted to the Firm over the Internet.
SEVERABILITY
Each paragraph of this Privacy Policy shall be and remain separate from and independent of and severable from all and any other paragraphs herein except where otherwise expressly indicated or indicated by the context of the agreement. The decision or declaration that one or more of the paragraphs are null and void shall not affect the remaining paragraphs of this privacy policy.

Our Privacy Policy may change from time to time. The most current version of the policy will govern our use of your information and will always be on the Platform. Any amendments to this Policy shall be deemed as accepted by the User on their continued use of the Platform.

DISCLAIMER
We do not store any account related information or any credit / debit card details. We shall not be liable for any loss or damage sustained by Users as a result of any disclosure (inadvertent or otherwise) of any information concerning the User's account, credit cards or debit cards in the course of any online transactions or payments made for any products and/or services offered through the Platform.
In case any Personal Information is shared by you with us, which is not requested by us during registration, (whether mandatorily or optionally), we will not be liable for any information security breach or disclosure in relation to such information.
DATA PROTECTION OFFICER/ GRIEVANCE OFFICER
In accordance with applicable laws, including the Information Technology Act, 2000 and the Digital Personal Data Protection Act, 2023, the Company has designated a Grievance Officer to address any concerns, complaints, or grievances relating to the use of the Platform or the processing of personal data.
